Early in 1777, Clinton received a full commission from Congress as a brigadier general in the Continental Army, a rank of much higher standing than his state militia commission, and he set up defenses at Fort Montgomery, just below present-day West Point. During the same period, Clinton was technically a member, but seldom attended, the drawn-out New York convention called to write a state constitution. Finally, the constitution was proclaimed in April 1777, and the fi rst election for governor was set in motion.

In April 1797 he also accepted the Republican nomination for a seat in the New York State assembly. There Burr and allies worked to secure passage of a bill that would allow aliens to buy and hold real estate in the state—a prerequisite to the success of sale of Burr’s own lands abroad. In August, he played a more creditable role by resolving a dispute between Alexander Hamilton and James Monroe that had threatened to end in a duel. It was during these years that Burr seems to have created the urban political machine linked to the Tammany Society that served him later.

Historians debate when and where political parties were born in the United States, but it seems clear that the confl icts over the Constitution and the way the new federal government was to be conducted were the catalysts for new forms of political organization and allegiance, especially in places such as Clinton’s New York. However, it is misleading (and somewhat bewildering to late twentieth century Americans) to describe the political alliances of the 1790s and early 1800s as parties in the modern sense.
